Extension of Due Date for Filing Income Tax Forms

Central Board of Direct Taxes (CBDT), Government of India has further extended the due dates for electronic filing of certain Income tax Forms vide Circular No. 15/2021 dated 03.08.2021. This extension in due dates of various compliances by CBDT is provided by exercising its power under section 119 of the Income-tax Act, 1961. The current article briefs the extension dates that are provided.

Synopsis of Notification

Because of constraints faced by the taxpayers due to the second wave of COVID-19, there were several representations for the extension of timelines for compliances under the Income-tax Act, 1961. Considering the representations, CBDT has further extended the due date for Filing Income Tax Forms for the FY 2020- 2021. It includes the extension of the following income tax forms:
  • Quarterly Statement of remittances by authorized dealer Quarter ending 30.06.2021
  • Equalization Levy Statement for FY 2020-21
  • Statement of Income paid or credited by an investment fund to its unit holder for FY 2020-21
  • Intimation to be made by a Pension Fund for Quater ending 30.06.2021
  • Intimation to be made by Sovereign Wealth Fund in respect of investments made by it in India for the quarter ending 30.06.2021

Due date to file Quarterly Statement in Form No. 15CC

The original due date to file the Quarterly statement in Form No. 15CC for the FY 2020-21 was 30th June 2021, extended to 15th July 2021 vide Circular No. 12/2021 dated 25th June 2021. CBDT now extended the due dates for electronic filing of Form No. 15CC for FY 2020-21 to August 31, 2021, under Rule 37BB of the Income Tax Rules.

Due date to file Equalization Levy Statement in Form No.1

The original due date to file the Equalization Levy Statement in Form No.1 for the Financial Year 2020-2021 was 30th June 2021 which was extended to 31st July 2021. With this circular, CBDT has extended the due date to file Equalization Levy Statement in Form No.1 to 31st August 2021.

Due date to file Form No. 64D

The original due date to file the Statement of Income paid or credited by an investment fund to its unit holder in Form No. 64D for the Previous Year 2020-2021 was 15th June 2021, extended to 15th July 2021. With this circular, CBDT has extended the due date to file Form No. 64D to 15th September 2021.

Due date to file Form No. 64C

The Statement of Income paid or credited by an investment fund to its unit holder in Form No. 64C for the Previous Year 2020-21, required to be furnished on or before June 30, 2021, under Rule 12CB of the Income-tax Rules, as extended to July 31, 2021, maybe furnished on or before September 30, 2021.

Other Income Tax Extension

Considering the non-availability of the utility for e-filing of certain forms, the CBDT has decided to extend the due dates for electronic filing of such Forms as under:
  • Intimation to be made by a Pension Fund regarding each investment made in India in Form No. 1OBBB for the quarter ending on June 30, 2021, is required to be furnished on or before July 31, 2021, under Rule 2DB of the Rules. As per this circular, CBDT extended the due date to September 30, 2021.
  • Intimation to be made by Sovereign Wealth Fund regarding investments made in India in Form II SWF for the quarter ending on June 30, 2021, required to be furnished on or before July 31, 2021. The due date is now extended to September 30, 2021.

Important Announcement for Taxpayer

No extension to the due date is provided to furnish application for filing re-registration or re-approval under section 12AB or section 80G or section 35 or section 10(23C) in Form No. 10A and the same is expiring on 31st August 2021. Further, there is no extension of the TDS/TCS statement furnishing the due date for quarter 4 of FY 2020-21 or Quarter 1 of FY 2021-2022.
