Maharashtra Occupancy Certificate

Occupancy certificate is an important legal document certifying that the construction of the building complies with the approved plans. In Maharashtra, occupancy certificate is issued by the Department of Urban Development only if the constructed building is in the appropriate condition for occupancy. In this article, we view the procedure for obtaining the Maharashtra Occupancy Certificate in detail.

Maharashtra Building Bye-Laws

As per the Provisions of the Maharashtra Building Bye-Laws, the application has to be filed after the completion of the building for the issuance of the occupancy certificate. The authorised officer after inspection may issue or refuse occupancy within twenty-one days from the date of application.

Uses of Occupancy Certificate

There are several benefits of getting an occupancy certificate in the respective state. The occupancy certificate has various advantages such as:

Occupancy Certificate Vs Completion Certificate

Completion Certificate: Upon termination of the construction, the builder or the owner of the building has to request for the Completion Certificate to the local municipal authority. If the building is completed as per the building approval form and if it satisfies other building criteria such as the distance from the highway, the height of the construction, fixation of rainwater harvesting system, etc., then the concerned authority will issue the Completion Certificate. Occupancy Certificate: Once the applicant gets the Completion Certificate, they have to apply for an Occupancy Certificate from the local municipal authority. Occupancy Certificate indicates that the building has complied with all the necessary building rules and regulations. This certificate is circulated by the local municipal authority or by the department of urban development and housing that grants no objection to occupy the building under the prescribed rules. An Occupancy Certificate is given only once the construction has been completed in all aspects.

Documents Required

The required documents are to be furnished along with the occupancy application form.
  • Application form.
  • Copy of sanctioned plans.
  • Photographs of entire buildings.
  • Structural Stability Certificate from a licensed Structural Engineer.
  • Completion certificate by a licensed Structural Engineer.
  • Completion certificate by a Architect Licensed Structural Engineer/ Engineer/ Supervisor.
  • Tree plantation compliance certificate from the Land Owner or Developer.

Applicable Charges

For an Occupancy Certificate in Maharashtra, the applicant has to remit a processing fee of Rs.500/-.

Application Procedure for Occupancy Certificate

To apply  for online occupancy certificate in Maharashtra, follow the steps mentioned below: Step 1: The applicant has to visit the official website of Building Plan Management of Urban Development Department. Step 2: Click on "Full occupancy certificate" which would be under the online services of the homepage.

User Registration

Step 3: The user has to select the new registration option, if registering for the first time. Step 4: Enter the required information like Applicant name, Email id, Mobile number, Address, etc. and click on "Submit" icon. Step 5: After registering with details the user will be redirected to the login page. Step 6: The user has to login by providing an email address and password and then click the "Login" icon and create a proposal for Full occupancy. Application form for Occupancy

Step 7: The Applicant may provide the details of the completed building in the application form and upload the documents required. Step 8: Once the required documents for full occupancy are uploaded in the proposal, and the applicant may pay the pre-approval charges for the proposal.

 Payment Generation

Step 9: After payment, the assistant town planner will check all the uploaded documents and proceed with the site visit, to verify the details. Step 10: Once approved after verification, then the proposal or application will be forwarded to the chief officer for final approval. Step 11: Chief officer will log  into the system and recheck the information of the application provided to approve the request.

Approval of the Proposal

Step 12: On approval of the proposal, the assistant town planner will verify the project for charges levied to the applicant. Step 13: Applicant will pay the post-approval charges for the proposal through the portal. Step 14: On payment of post-approval charges, the chief officer will digitally sign the full occupancy completion certificate. Step 15: The applicant can download the Full Occupancy Certificate will be from the portal.

Time Frame

The entire process of granting an occupancy certificate will be completed within twenty-one days from the date of application.

Concerned Authority

The chief officer of municipal council after the inspection is responsible for issuing the digitally signed occupancy certificate.

Rejection of Occupancy Certificate

If the Occupancy Certificate is not issued within time limit mentioned above, the applicant should submit a notice with an affidavit that the construction is strict as per the approved plans and no dues are pending in development charges or any other form of payment. After submission of such a notice to the concerned authority, an occupancy certificate will be granted in sixty days from the date of notice received.

The applicant can check the status of the application online by following the steps below: Step 1: Revisit the official portal and click on "Application status" which is present on the homepage. Step 2:  Click on "Full occupancy" option from the listed out the menu. Step 3: Enter your application number and click on the “Search” icon to know the status of your application. Download Occupancy Certificate

Follow the steps below to download occupancy certificate online. Step 1: Applicant must visit the same website mentioned as above. Step 2: Click on "ease of doing business" and select "Approval certificates" from the menu. Step 3: Enter the following details like
  • Council name
  • Name of service
  • Proposal number
after which the " Search" icon should be clicked.
